Welcome to Akers Family Farm. By accessing our website or placing an order, you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use our website or purchase our products.

Acceptance of Terms

By placing an order with Akers Family Farm, you acknowledge that you have read and agree to these Terms of Service, our Shipping Policy, Return & Refund Policy, Privacy Policy, and any other policies published on our website.

Products

We strive to accurately describe all products and provide representative photographs whenever possible.

Because we sell living and naturally produced agricultural products, variations are normal. Egg color, shell markings, feather color, comb type, pattern, and other characteristics may vary from photographs or descriptions.

Hatching Eggs

Purchasing shipped hatching eggs involves inherent risks that are beyond our control. Hatchability may be affected by shipping conditions, incubation practices, equipment, environmental conditions, genetics, and many other factors.

By purchasing hatching eggs, you acknowledge these risks and understand that Akers Family Farm does not guarantee fertility, hatch rates, or the number of chicks that will hatch.

Please refer to our Hatching Guide before incubating your eggs.

Order Acceptance

Submission of an order does not guarantee acceptance.

Akers Family Farm reserves the right to refuse, cancel, or limit any order at our sole discretion, including but not limited to product availability, pricing errors, suspected fraud, or other circumstances.

If payment has already been processed for an order that cannot be fulfilled, a refund will be issued for the unfulfilled portion of the order.

Shipping

Shipping is governed by our Shipping Policy.

Once a package has been accepted by USPS, responsibility for transportation rests with the postal service. Akers Family Farm is not responsible for delays caused by USPS, weather, or other circumstances beyond our control.

Returns & Refunds

Our Return & Refund Policy is incorporated into these Terms of Service.

All customers are responsible for reviewing this policy before placing an order.

Customer Responsibilities

Customers are responsible for:

• Providing accurate billing and shipping information.

• Providing a valid phone number if they would like us to request Hold for Pickup through USPS.

• Reviewing all product descriptions and policies before placing an order.

• Following proper incubation and animal husbandry practices after receiving their order.

• Ensuring that ownership of poultry or other livestock is permitted under all applicable local, state, and federal laws.

Intellectual Property

All photographs, logos, graphics, text, product descriptions, breeding information, and other content appearing on this website are the property of Akers Family Farm unless otherwise noted.

No content may be copied, reproduced, distributed, or used without prior written permission.

Limitation of Liability

To the fullest extent permitted by law, Akers Family Farm shall not be liable for indirect, incidental, consequential, or special damages arising from the purchase or use of our products or use of this website.

Our maximum liability shall not exceed the purchase price paid for the product.

Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict of law principles.
